The LTL Firm realizes that intellectual property often represents the primary component of a company's value and reputation. As such, we provide practical advice to our clients on how best to protect their intellectual property, not just in the US but also in China. We have successfully litigated numerous patent, trademark/trade dress, copyright, trade secret, and idea theft matters.  In particular, we serve corporate clients in aggressively defending against patent infringement lawsuits.  We handle patent and other IP litigation matters across the United States including Calfornia, Texas, Delaware, and New York.

We are proud to serve clients in diverse industries, including the entertainment, computer technology, consumer electronics, internet, financial services, automotive, cosmetics, toy, nail salon, and retail sectors. We have the scientific background necessary to understand and effectively try cases involving complex technical issues (which often arise in intellectual property disputes). For example, one of our attorneys was formerly general counsel of a computer hardware company, where he dealt extensively with complex hardware and software issues.  Another attorney was a chemical engineer and member of the Patent Bar before going to law school at Harvard.

 

Representative Matters

  • Litigation

    • Currently representing VIZIO against patent infringement claims in California, Texas and Delaware.
    • Obtained favorable settlement for DISNEY in patent infringement and idea theft case.
    • Obtained complete "wins" for clients in patent claim construction/Markman hearings.
    • Obtained summary judgment for two clients in the interior tile industry less than one week from trial in copyright and trade dress infringement case.
    • Argued complex 9th Circuit trademark appeal; substituted in as counsel for oral argument after briefs were already completed.
    • Enforced patent portfolio for NASDAQ-listed company against several Fortune 100 companies, including Google.
    • Defended one of world's largest sporting shoes and apparel companies in design patent case where plaintiff sought over $60 million in damages; resulted in summary judgment for client; affirmed on appeal by the Federal Circuit.
    • Obtained significant confidential settlement in trademark case on behalf of client on contingency fee basis.
    • Won summary dismissal of a $10 million trade secret lawsuit filed against client by a 400-lawyer firm.
    • Obtained “walk away” settlement for client in medical services industry in a trade secret lawsuit filed by AmLaw 100 law firm.
  • Counseling

    • Conducted IP audit for one of the world's largest automobile accessories and parts manufacturers by visiting all plants in China, and then providing comprehensive advice on structuring and strategic management of IP portfolio.
    • Assisted US industrial design company with registering and protecting its intellectual property in China, as well as with its OEM contracts with Chinese manufacturers.
